1. Agreement
These Terms of Service form an agreement between Estebyan Global Platform (“Estebyan”, “we”, “us”) and the person or organisation using the service (“you”). By creating an account, accepting an order, or using Estebyan, you agree to these terms and our Privacy Policy.
If you use Estebyan for an organisation, you confirm that you have authority to accept these terms for that organisation. If a separate signed agreement applies, that agreement controls where it conflicts with these terms.
2. Accounts and access
You must provide accurate account information, keep credentials confidential, and promptly update changes. You are responsible for activity under your account and for assigning appropriate roles to workspace users. Tell us promptly if you suspect unauthorised access.
You may not share individual credentials, evade plan limits, or access another tenant’s information. We may require email or phone verification and use security controls to protect login and public endpoints.
3. Using Estebyan
Estebyan provides tools to create and publish surveys, collect and analyse responses, prepare exports, communicate with participants, and manage related workflows. Features and limits depend on your plan, location, configuration, and release status.
You are responsible for your surveys, respondent notices, invitations, collection methods, account users, and use of results. You must obtain required permissions and use a lawful basis for collecting personal or sensitive information.
4. Customer content and data
You retain ownership of survey questions, response data, files, branding, and other content you submit to Estebyan (“Customer Content”). You grant us a limited right to host, copy, transmit, display, process, and back up Customer Content only as needed to provide, secure, support, and improve the service or comply with law.
You confirm that you have the rights and notices needed to use Customer Content. We do not acquire ownership of it. Feedback you voluntarily provide about Estebyan may be used without restriction or payment, provided we do not identify you without permission.
5. Acceptable use
You may not use Estebyan to:
- break the law, infringe rights, deceive respondents, or send unlawful messages;
- collect information without required notice, consent, or authority;
- upload malware, probe security, disrupt the service, or bypass access controls;
- send spam or abusive, threatening, discriminatory, or exploitative content;
- reverse engineer the service except where the law does not allow that restriction;
- use automated means that create unreasonable load or avoid documented API controls; or
- resell or provide access to Estebyan unless an agreement permits it.
We may remove content or restrict activity when reasonably necessary to protect respondents, customers, Estebyan, or the public.
6. Plans, fees, and renewal
Basic is free within its stated limits. Pro costs $7 USD per month unless a different price is shown at checkout. Custom pricing is set in an order or separate agreement. Taxes and usage-based charges, where applicable, are additional.
Paid plans renew automatically each billing period until cancelled. You authorise the applicable charge through the payment method shown at checkout. You can cancel before renewal; access continues through the paid period and then returns to the available free tier unless otherwise stated. Fees already paid are non-refundable except where required by law or stated in an order.
We may change prices with advance notice. Price changes take effect at a future renewal, not during a period already paid.
7. Third-party services
Estebyan uses third-party infrastructure and may connect to email, SMS, maps, AI, storage, payment, and other services. Their availability can affect related features. When you enable an optional integration, additional provider terms or charges may apply.
AI-assisted output may be incomplete or inaccurate. You must review generated surveys and translations before publishing them, especially for legal, medical, safety, or high-impact uses.
8. Availability and service changes
We work to keep Estebyan available and protect acknowledged submissions, but maintenance, emergencies, networks, and third-party providers may interrupt access. We may change, add, or retire features. We will provide reasonable notice where a change materially reduces a paid service.
Beta, preview, or early-access features may change and may not have the same support or availability commitments as generally available features.
9. Warranties and liability
To the extent permitted by law, Estebyan is provided “as is” and “as available”. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that surveys will produce a particular response rate, sample quality, decision, or outcome.
To the extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, goodwill, or data. Estebyan’s total liability arising from the service will not exceed the fees you paid for the service during the 12 months before the event giving rise to the claim. These limits do not apply where liability cannot lawfully be limited.
You will defend and indemnify Estebyan against third-party claims arising from your Customer Content, surveys, respondent communications, unlawful use, or breach of these terms, to the extent permitted by law.
10. Suspension and termination
You may stop using Estebyan at any time. We may suspend or terminate access for material breach, non-payment, security risk, unlawful activity, or harm to the service or others. Where practical, we will give notice and an opportunity to fix the issue.
After termination, your right to use the service ends. Provisions that by their nature should continue will survive, including payment duties, ownership, disclaimers, liability limits, and dispute terms. Data export and deletion are subject to your plan, retention settings, legal obligations, and any separate agreement.
11. General terms and contact
You may not transfer these terms without our consent, except as part of a permitted corporate transaction. We may transfer them as part of a reorganisation, financing, merger, acquisition, or sale of assets. If a provision is unenforceable, the remaining provisions continue. A delay in enforcement is not a waiver.
The governing law and dispute forum will be identified in your order, checkout terms, or applicable local terms. If none is specified, contact us before subscribing so the appropriate contracting terms can be confirmed.
